Michigan Anti-Vape Rule Takes Effect

Michigan’s emergency rules banning flavored nicotine vaping products have been released.

The rules become effective immediately. Retailers and resellers – including online sellers – have 14 days to comply.

Governor Gretchen Whitmer issued the emergency declaration September 4th, accusing e-cigarette companies of “getting our kids hooked on nicotine by marketing candy-flavored vaping products as safe.”

President Donald Trump has since announced his intention to ban the products nationally.

The states of New York and California have also made similar moves.

The Michigan rules are effective for 180 days and can be extended for six months. The Michigan Department of Health and Human Services has filed a Request for Rulemaking, which will allow the department to develop permanent rules.

A bill has already been introduced into the Michigan House that would limit the governor’s ability to ban e-cigarettes without consent from the legislature.
