Michigan Attorney General Dana Nessel is proceeding with her court case against the proposed tunnel under the Straits of Mackinac that would house the Enbridge Line 5 pipeline.
The tunnel was approved in the waning days of the Rick Snyder administration. Enbridge would build it, and relocate Line 5 from its current position on the floor of the Straits.
Last fall, a Court of Claims judge rejected Nessel’s argument that the tunnel approval was unconstitutional. The AG’s office filed paperwork yesterday asking the Court of Appeals to overturn that decision.
The Court of Appeals yesterday denied Nessel’s request for a stay pending appeal. That means Enbridge can continue work on the tunnel while the appeals process continues.
This case is not related to the Attorney General’s lawsuit that seeks to shut down Line 5 completely.
