Governor Rick Snyder will appeal a Court of Appeals ruling that Michigan must return contributions that school employees made toward their retirement health care.
The governor will do this without the help of Attorney General Bill Schuette.
He says the funds were collected under a law that the courts had found unconstitutional and were still needed to keep the retirement system solvent.
But Schuette has announced that the governor would have to use special counsel for the effort, a move that is rare for an Attorney General.
