Portions of Michigan’s Sex Offender Registry Are Ruled Unconstitutional

A federal judge has ruled portions of Michigan’s Sex Offender Registry Act are unconstitutional.

The ruling affects the 44,000 offenders on the website.

The judge presiding over the case, US District Court Judge Robert Cleland, realizes his ruling, will fracture the existing structure of the registry, but went with his ruling in hopes of motivating lawmakers to re-write the statutes that he ruled unconstitutional.

The legislature has 60 days, from this past Friday, to pass statutes, which will be more in step with federal guidelines. 

Portions of the ruling deemed unconstitutional, included registration requirements, loitering restrictions and residency exclusions.
