Lawsuits Over Outlet Where New KFC Is Being Built

Construction is well underway for the new KFC building in West Houghton.

A press release was announced for Glenn Flewelling, who owns and is building the new KFC building just off West Sharon Ave. across the street from Culvers.

The press release mentioned the previous lawsuit filed from the land and building owner that Tadych’s Marketplace operates out of. The Tadych’s Marketplace business is not involved in this lawsuit. It is only the land owner, Daniel G Kamin Houghton LLC, that has filed a lawsuit.

The 12th circuit court judge at the time ruled in favor of Flewelling, who then started the building process of the new KFC.

Kamin Houghton LLC has appealed the decision in the state court of appeals. Kamin Houghton LLC did not ask for a stay in place for construction.  


Evangel Community Church released a press release in answer to Flewelling.

They stated that when they purchased the land from Shopko, it was believed there was an easement with the third-party owners that stated the land would not be built on, and it would be kept as parking.

Without being able to reach a compromise, the church filed a formal complaint, which is separate from the appeal filed by Kamin.

There is a court date set for July 31.

The plaintiff is Evangel Baptist Church of Houghton, and the defendants are Sweetwater Building Company LLC, Flewelling Properties and DP Construction Inc.
