Evan Dixon’s Waiver Hearing Set for August in First Degree Murder Case

Evan Dixon will have a waiver hearing scheduled in August.  Yesterday the 97th district court held a status hearing to keep the court, defense and prosecution on the same page. Dixon has been charged with the first degree murder of Theron Duncan in November 2023 at the Douglas House Saloon.

The case has been presided over by Judge Anna Talaska from Gogebic County to avoid potential conflicts. Evan Dixon has practiced law in Houghton County for several years and has had numerous cases held before Houghton County Judge Nicolas Daavettilaa. Daavettilaa excused himself from the case during initial proceedings.

Houghton County Prosecutor Dan Helmer has presented a plea deal to defense attorney Karl Numminen. He will discuss the offer with Dixon, before meeting with Helmer for negotiations. The court has set a waiver hearing for August 14th, to allow Dixon an opportunity to waive his right to the preliminary if he accepts the county’s plea deal. Numminen also noted that his team still awaits the results of a criminal reasonability report that may impact a decision. Dixon will return to the 97th district court for a waiver hearing on August 14th.
