Café Rosetta reopening possible by Thursday

Attorney David Kallman says that he expects an agreement between Café Rosetta and the Michigan Department of Agriculture and Rural Development to be reached as early as Tuesday afternoon. That would pave the way for the restaurant to potentially reopen this Thursday pending an on-site examination performed by the agency.

Kallman sounded optimistic and relieved on the phone, with the culmination of weeks of negotiations between the parties nearing its end. A reopening agreement would end all litigation involving the two sides.

We have an appeal pending and that was assigned to the judge in Marquette, and of course they have the case here in Lansing with Judge [Wanda] Stokes. So the discussion at this point is that we would both dismiss our cases.

Café Rosetta’s business license was revoked when it continued operating after the Epidemic Order went into effect in November. Another area restaurant, The Mine Shaft, lost a similar appeal in Marquette’s 25th Circuit Court. Judge Jennifer Mazucchi said that the state legislature had made no mechanism available for such a petition.
